- Abstract
- At International level efforts have been made to reach a universally accepted definition of the \"protected area\" (PA) and a common system of classification of PAs in order to reduce the confusion arising from the use of many different terms in domestic legislations and treaties and to provide an international framework for the collection, handling and dissemination of data regarding PAs.
Dealing with the concept, the practice shows that treaties concluded at regional level for the conservation of flora and fauna of a particular area include different notions of PA consistent with the local exigencies of environmental protection. At universal level, the 1992 Convention on Biological Diversity (CBD) is the first international instrument to give, in Article 2, a legal definition of \"protected area\" broad enough to include different categories of PAs designated by States parties to protect biodiversity. In the European Union system for the protection of biodiversity, known as \"Natura 2000\", a general definition of PA is lacking, while in the domestic legislations concerning PAs, each State provides for its own system of classification and the definitions are consistent with the conservation objectives of each area.
As far as the international classification of PAs is concerned, in 1978 the International Union for the Conservation of Nature (IUCN) elaborated in co-cooperation with the United Nations a first system based on ten categories. This was later revised in 1994 in order to render the classification consistent with the principle of sustainable development affirmed by the 1992 United Nations Conference on Environment and Development (UNCED). The new classification contained six categories of PAs and for each area the definition was based on management criteria rather than conservation objectives. The principles at the basis of the IUCN classification, considered by many stakeholders too management-oriented, have been under revision in 2004 without modifying the six category system. Indeed, the importance of a single international classification system for PAs has been recognized also by the Conference of the Parties to CBD, even if most of the States parties have not incorporated the IUCN classification into domestic legislation, as in the case of Italy.
